Handling Claims Notified in Connection with the Winding-Up of Insolvent Insurance Companies
We process personal data about you if you have an ongoing case or have submitted a claim in connection with the winding-up of an insolvent insurance company whose liabilities fall within the coverage of the Danish Guarantee Fund for Non-life Insurance Companies. The Fund also processes information about you if you reported a claim before the bankruptcy order was issued and the claim is to be covered by the Fund.
The Danish Guarantee Fund for Non-life Insurance Companies processes your personal data on the basis of Article 6(1)(c) of the General Data Protection Regulation (GDPR) in respect of ordinary and confidential personal data, as the processing is necessary to comply with a legal obligation.
Your Danish civil registration number (CPR number) is processed pursuant to Section 11(2)(4) of the Danish Data Protection Act, cf. Section 7(1) of the Danish Data Protection Act and Article 9(2)(f) of the GDPR.
If you submit sensitive personal data, such data will be processed pursuant to Article 6(1)(c) and Article 9(2)(f) of the GDPR, cf. Section 7 of the Danish Data Protection Act.
In connection with handling claims notified during the winding-up of insolvent insurance companies, the Fund will process information about you, such as your name, address, email address, CPR number, telephone number, education and general insurance information included in the claims handling process for consumer insurance policies. In cases involving reported personal injuries under consumer insurance policies, we may also process health information about you.
The Fund transfers your personal data to Topdanmark Forsikring A/S and Caplin, which have been entrusted with processing the insurance claims covered by and reported to the Fund.
In certain cases, your personal data may be disclosed to persons associated with insurance policies, advisers, credit institutions, business partners, public administrative authorities (including the Danish Tax Agency (SKAT), municipalities and the Danish Financial Supervisory Authority), the courts, the police and Betalingsservice. Such disclosure will only take place where it complies with the provisions of the GDPR.
Your personal data will be retained for as long as necessary to process your case and will be deleted no later than 10 years after your case has been closed, in accordance with the applicable rules under the Danish Bookkeeping Act and the Danish Limitation Act.
