Mandatory membership of the Danish Guarantee Fund for Non-Life Insurance Companies

As of 1 January 2019 all direct providers of non-life insurance in the EU/EEC which through branches or cross-border services provide (or wish to provide) non-life insurance in Denmark, are obliged to be a member of the Danish Guarantee Fund for Non-Life Insurance Companies (the Guarantee Fund).

All direct providers of non-life insurance in the EU/EEC which through branches or cross-border services provide (or wish to provide) non-life insurance in Denmark, shall make a one-time contribution to the Guarantee Fund upon enrollment.

The contribution is fixed at DKK 50 per police for the following private line insurance policies:

1) Motorforsikringer (motor liability insurance)
2) Familieforsikringer (household contents insurance)
3) Husejerforsikringer (property insurance)
4) Sundhedsforsirkinger (health insurance)
5) Ejerskifteforsikringer (latent defect insurance - change-of ownership)
6) Sælgeransvarsforsikring (property sellers liability insurance) and
7) Byggeskadeforsikringer (structual warranty insurance – new build)

Notwithstanding the above the contribution can however not be less than DKK 100,000.

How to enroll
The non-life insurance company must determine whether the one-time contribution amounts to more than DKK 100,000.

If the insurance company is to pay a one-time contribution of more than DKK 100,000, a statement from a state-authorized or registered accountant must be submitted in connection with the payment stating that the contribution is correctly calculated.

The independent auditors report on the calculaton of lump sum contributions to the Danish Garantee Fund

If the insurance company determines the one-time contribution to be the minimum amount of DKK 100,000, a statement from the insurance company's responsible management/authorized signatory must be submitted in connection with the payment stating that the contribution is correctly calculated.

To this end, the following statement must be completed:

Statement in relation to a lump sum contribution of DKK 100,000

All insurance companies that have notified the Danish Financial Supervisory Authority of their intention to carry out insurance activities in Denmark and which, as of 1 January 2019 will be obliged to be a member of the Guarantee Fund and the contribution to the Guarantee Fund must be paid to the Guarantee Fund no later than 1 March, 2019.


Contribution to the Guarantee Fund for 2019
As a result of the Gable Insurance and Alpha Insurance bankruptcies the Danish Guarantee Fund for Non-life Insurance Companies (“the Fund”) no longer meets the statutory requirement to have a capital of DKK 300 mill.

The Danish Financial Supervisory Authority has therefore, in accordance with section 3 in the of the Guarantee Fund for Non-life Insurance Companies Act, see consolidated act no. 1050 of 8 September 2017 as amended by act no. 375 of 1 May 2018, section 1, instructed the Fund to collect contributions from members of the Fund, in order to re-establish the Fund’s capital.

The contribution is determined by the Danish Financial Supervisory Authority and is fixed at DKK 40 per police for the following private line insurance policies:

1) Motorforsikringer (motor liability insurance)
2) Familieforsikringer (household contents insurance)
3) Husejerforsikringer (property insurance)
4) Sundhedsforsirkinger (health insurance)
5) Ejerskifteforsikringer(latent defect insurance - change-of-ownership)
6) Sælgeransvarsforsikring (property sellers liability insurance) and
7) Byggeskadeforsikringer (structual warranty insurance – new build).
